These Terms of Service (“Terms”) govern chauffeured transportation services provided by Luxesmith LLC (“Luxesmith,” “we,” “us,” “our”), a Texas limited liability company located at 5900 Balcones Drive, Suite 100, Austin, TX 78731, and your use of this website. By booking a ride, confirming a reservation, paying an invoice, or using this site, you agree to these Terms. If you are booking on behalf of a group, you accept these Terms for every passenger in your party and are responsible for their conduct.
1. Our services
We provide private, pre-arranged chauffeured ground transportation in Austin and throughout Central Texas, including airport transfers, hourly hire, point-to-point trips, weddings, corporate travel, and special events. All service is by reservation. We are not a taxi, rideshare, or on-demand street-hail service, and we do not accept street hails.
2. Reservations and confirmation
A reservation is not guaranteed until we confirm it. Online bookings require a minimum of three (3) hours’ advance notice; we will always try to accommodate shorter notice by phone. Quoted rates assume the itinerary you provide. If the trip changes materially (added stops, extra passengers, a different vehicle class, or additional time), the price may change accordingly, and we will tell you before charging where practical.
We may confirm reservations, send trip details, invoices, and receipts by email or text message using the contact information you provide. By providing your phone number you consent to receive transactional messages about your booking; message and data rates may apply, and you may opt out of texts at any time by replying STOP or by telling your concierge.
3. Pricing, payment, and gratuity
Rates shown on this site are estimates based on the details entered and reflect our minimum for a point-to-point transfer within the downtown Austin area. Final pricing may reflect actual route, wait time, tolls, added stops, extra time, or requested amenities. Hourly bookings are subject to the minimum hours stated for the selected vehicle.
When you save a payment method with us, it is stored securely by our payment processor (Stripe); Luxesmith never stores your full card number. You are not charged when you book. For most trips we charge your card on file after your ride is complete, in the amount shown on your trip summary. Where we send an invoice for immediate payment, payment is due when you complete it. Gratuity is optional and never added automatically; any gratuity you choose is charged with your authorization.
If a payment is declined, returned, or reversed, you remain responsible for the amount owed and any fees our processor charges us as a result. Bank (ACH) payments may take several business days to settle and can fail after being initiated.
4. Cancellations, changes, and no-shows
Cancellations and changes are governed by our Cancellation Policy, which forms part of these Terms. In summary: standard reservations may be cancelled at no charge up to 24 hours before pickup; Formula 1 weekends and full-day bookings require at least two weeks’ notice for a full refund; and no-shows are charged in full. Any specific terms on your written quote or booking confirmation take precedence.
5. Wait time, delays, and events beyond our control
We monitor tracked flights and adjust for airline delays at no additional charge. For non-airport pickups, complimentary wait time is limited; extended waiting may be billed in increments at the applicable hourly rate, and we will make reasonable efforts to notify you first.
We are not responsible for delays or failure to perform caused by circumstances beyond our reasonable control, including traffic, road closures, accidents, severe weather, natural disasters, acts of government, labor disruption, utility or network failure, or mechanical breakdown. In such cases we will make reasonable efforts to provide an alternative vehicle or reschedule, and our liability is limited as described in Section 11.
6. Vehicles and substitutions
Vehicle photographs and model names on this site are representative of the class of vehicle, not a guarantee of a specific make, model, year, or color. If your reserved vehicle becomes unavailable due to mechanical issues or circumstances beyond our control, we may substitute a vehicle of equal or greater capacity and class. Passenger capacities listed are maximums set by seating and safety requirements and may not be exceeded under any circumstances.
7. Passenger conduct
All passengers must comply with applicable law, wear seat belts where required, remain seated while the vehicle is moving, and follow the chauffeur’s reasonable safety instructions. The chauffeur has full discretion over the safe operation and route of the vehicle.
Smoking and vaping are prohibited in all vehicles. Illegal drugs, weapons, and any unlawful activity are strictly prohibited. Standing through a sunroof, hanging out of windows, or any conduct that endangers passengers, the chauffeur, or the public is prohibited.
The chauffeur may refuse service to, or immediately end the trip of, any passenger who is unsafe, unlawful, abusive, or in violation of these Terms. If a trip is ended for these reasons, no refund is due and the full fare remains payable.
8. Alcohol
Under Texas law, passengers, but never the driver, may possess and consume alcoholic beverages in a vehicle used primarily to transport passengers for compensation. Consumption is permitted only by passengers who are 21 years of age or older, and only where we have confirmed it for your booking.
Furnishing alcohol to anyone under 21 is prohibited, and we will end the trip if it occurs. We may refuse to begin or continue a trip if passengers appear dangerously intoxicated. Where alcohol is permitted, you are responsible for removing all containers at the end of the trip and for any cleaning or damage charges under Section 9.
9. Damage, cleaning, and lost property
You are responsible for damage or excessive soiling caused by you or your party beyond normal wear. So that costs are clear in advance, the following flat fees apply, and you authorize us to bill your payment method on file for them:
- Smoking or vaping in the vehicle: $500. This covers deep cleaning and the time the vehicle is unavailable.
- Burns to upholstery, carpet, or trim: $500 per burn.
- Torn, cut, or permanently stained upholstery: $700.
- Sickness requiring sanitation (vomiting): $300.
- Spilled food or drink requiring extraction cleaning: $200.
- Glitter, confetti, gum, or similar on carpet or seating: $150.
- Broken or missing glassware: $20 each.
These fees cover cleaning and the loss of use while the vehicle is out of service. Damage not listed above (including broken fixtures, panels, or body damage) is billed at the actual documented cost of repair, plus the value of any bookings we must cancel while the vehicle is unavailable. We will provide photographs and documentation for any charge under this section before billing it.
Please take your belongings with you. We are not responsible for property left in, lost from, or damaged in a vehicle. If we find an item we will make reasonable efforts to return it, and may charge a delivery fee.
10. Children, accessibility, and animals
Texas law requires appropriate child passenger safety seats for children under the age of eight who are not taller than 4’9”. Please tell us at booking if you need a child seat so we can arrange it; you are responsible for ensuring any child is properly secured.
Service animals are always welcome at no additional charge, in accordance with the Americans with Disabilities Act. Pets that are not service animals are welcome only when arranged in advance and may be subject to a cleaning charge. Please tell us in advance about wheelchair or other accessibility needs so we can assign a suitable vehicle.
11. Limitation of liability
To the fullest extent permitted by Texas law, Luxesmith’s total liability arising out of or relating to any reservation or these Terms will not exceed the amount you paid for the affected trip. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, missed flights, missed connections, or missed events, however caused.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for our own gross negligence, willful misconduct, or personal injury caused by our negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Insurance and licensing
Luxesmith maintains the commercial automobile liability insurance and operating authority required for the chauffeured transportation services we provide. Our coverage applies to our operations; it does not insure passengers’ personal property.
13. Indemnification
You agree to indemnify and hold harmless Luxesmith LLC, its owners, employees, and chauffeurs from claims, damages, fines, and reasonable costs arising from your or your party’s breach of these Terms, unlawful conduct, or damage to the vehicle.
14. Website use and intellectual property
The content of this site (text, design, photographs, code, and the LUXESMITH name and logo) is owned by Luxesmith LLC or used with permission, and may not be copied, reproduced, or used commercially without our written consent. You agree not to misuse this site, including attempting to interfere with its operation, access it by automated means, or use it for any unlawful purpose.
15. Privacy
Our Privacy Policy explains what information we collect and how we use it, and forms part of these Terms.
16. Disputes and governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The exclusive venue for any dispute is the state or federal courts located in Travis County, Texas, and you and Luxesmith consent to that jurisdiction.

17. Changes to these Terms
We may update these Terms from time to time. The effective date above reflects the current version, and the version in effect when you book governs that reservation.
18. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Cancellation Policy, Privacy Policy, and your written quote or booking confirmation, are the entire agreement between you and Luxesmith regarding our services.
